These terms govern your use of this website and, if you go ahead with onboarding, your use of ToshaPOS itself. They're an agreement between you and AgriTosha Limited ("AgriTosha," "we," "us," or "our"), a company registered in Kenya and based in Bungoma. By browsing this site, booking a demo, or using ToshaPOS after onboarding, you agree to these terms.
If anything here doesn't match what we've actually agreed with you, our direct conversation and any written agreement between us takes priority. Questions go to [email protected].
ToshaPOS is point-of-sale software built for agrovet shops: sales recording, stock tracking, credit tracking, and reporting. On a laptop, desktop, iPhone, or iPad, it's accessed through a web browser. On an Android phone or tablet, it's accessed through the ToshaPOS Android app. Either way, it's a hosted service, we run it and keep it up to date, and your data lives in our systems regardless of which device you use.
You don't create a ToshaPOS account by yourself on this website. Access starts with a demo request, a conversation with our team, and an onboarding process where we help you set up your shop. You become a customer once that onboarding is agreed and complete, not before.
We don't publish fixed prices because shops differ in size and needs. Pricing is discussed and agreed with you individually during onboarding, along with how and when payment is made. Those specific terms, once agreed with you, form part of your agreement with us alongside this document.
Data you enter into ToshaPOS, your product list, sales records, and customer records, belongs to you. We process it to provide the service to you and as described in our Privacy Policy. If you stop using ToshaPOS, you can request an export of your data before your account closes.
ToshaPOS can display product information such as dosage rates, application guidance, and safety notes, and can print this on customer receipts. This information is provided for convenience and is drawn from product labels and manufacturer guidance where available. It doesn't replace the product's own label, manufacturer instructions, or professional agronomic or veterinary advice. As the shop, you're responsible for verifying this information before passing it on to a customer, particularly for anything safety-related.
You agree to use ToshaPOS and this website lawfully, and not to attempt to disrupt, reverse-engineer, or gain unauthorized access to the service or to other customers' data. If you give staff their own logins, you're responsible for how they use their access.
We work to keep ToshaPOS available and reliable, but we don't guarantee it will be uninterrupted or error-free. We may update or improve the service over time; if a change would materially affect how you use it, we'll aim to let you know in advance.
You can cancel your use of ToshaPOS at any time by contacting us. We'll agree the details, including your data export, with you directly. We may also suspend or end access to the service for a customer who breaches these terms.
ToshaPOS is provided on an "as is" basis. To the extent permitted by Kenyan law, AgriTosha isn't liable for indirect or consequential losses arising from your use of the service, including losses from downtime, data entry errors, or reliance on product information described in section 5. Nothing in these terms limits any liability that can't lawfully be limited.
These terms are governed by the laws of Kenya, and any dispute arising from them will be subject to the jurisdiction of the Kenyan courts.
We may update these terms from time to time. Continued use of the website or ToshaPOS after a change means you accept the updated terms. We'll update the "last updated" date above whenever we do.
